Asilimia is a payment platform that allows users to earn and save points with each transaction. We make mobile payments easy, scalable and affordable (collectively, "Services"). These Terms & Conditions (“T&C” or “Agreement”) apply to all users of Asilimia's website as published at www.asilimia.co.ke and any mobile-device applications we offer, such our Android applications, branded "Asilimia". By registering on (one of) our platforms and using our Services, you accept to be bound by this Agreement as specified below.
Users are obliged to provide truthful and accurate information when registering (i.e., a valid ID number) and to use the Services only in accordance with relevant regulations. It is illegal to transmit any malicious code to the application or otherwise infringe the integrity, availability, or confidentiality of the system. Any case of (a suspicion of) unauthorized use of the Services needs to be promptly notified to Asilimia.
Downloading the Asilimia application is free of charge. When transacting, users agree to be charged standard MPESA transaction fees corresponding to the value of the transaction. In exchange, users earn points that can be later redeemed for free rewards. The following cost structure applies:
We may collect certain types of Information, including Information that can be used to identify you, which includes name, email address and phone number (“Personal Information”), and Information that does not identify you personally. You may provide us with Personal Information when you register for an account, use the Services or send us customer service related requests.

If you use a social media platform, a mobile device or other third-party method of communication to interact with Asilimia or the Services, that platform may have a specific privacy statement that governs the use of Information related to that platform. If you have questions about the security and privacy settings of your mobile device, please refer to instructions from your mobile service provider or the manufacturer of your device to learn how to adjust your settings.
If you use the Services on a mobile device and your mobile device's settings allow it, we may collect Information from your mobile device. Please see the ‘Your Choices’ section under the heading "mobile" for more information on the types of Information that Asilimia may collect from the Services operating on a mobile device.
You use Asilimia as a mobile money services platform, and we will use the Information we collect from and about you in many ways to help provide you with tailored services. Our uses of Information will change over time to take advantage of the latest technology and methods to help improve our services and the advertising and marketing you receive from us. By using the Services, you agree that we may change our services and advertising and marketing practices at any time. If you disagree with how we provide the services or are advertising and marketing to you, you may stop using the Services.
We work with various partners. To facilitate these activities, we may share Information about you with our partners. By using the Services, you agree that we may share Information about you for these purposes. If you disagree with the way we share Information about you, you may stop using the Services and ask us to delete your account.

Asilimia may also disclose Information about you that is not personally identifiable. For example, we may provide our merchants, business partners, or other third parties with reports that contain aggregated data, statistical data, and/or anonymized data.
When you use our Services, we may collect certain information by automated or electronic means, using technologies such as cookies, browser analysis tools, and web server logs. As you use our Services, your browser and devices communicate with servers operated by us, our business partners and services providers to coordinate and record the interactivity and fill your requests for services and information.
The information from cookies and related technology is stored in web server logs and also in web cookies kept on your computers or mobile devices, which are then transmitted back to our Services by your computers or mobile devices. These servers are operated and the cookies managed by us, our business partners or our service providers.
For example, when you access our Services, Asilimia and our service providers may place cookies on your computers or mobile devices. We think that you benefit from a more personalized experience when we know more about you and the kinds of services you like. However, you can limit the information you provide to Asilimia and the communications that Asilimia sends to you.

The Information collected by our Services via a mobile device may include the following: (i) periodic collection of your location and time of day; (ii) the names of the other applications on your mobile device and, if you use an Android-based mobile device, how you use them (e.g., frequency and duration of use); (iii) Information about your mobile device (e.g., make, model, operating system, identifier, and other similar Information); and (iv) Information about your use of features, functions, or clicks on notifications or content.
By providing us with your mobile telephone number, you consent to receive SMS text messages at that number as requested for account verification and authentication and other purposes related to the Service. You may also receive an SMS from Asilimia if you are invited by another user to join Asilimia.
If you want to close your account or have other questions or requests, or if you would like to access or request a correction to any other Information we hold regarding you, please contact us at [email protected] .
In response, we will cancel or remove your Information but may retain and use copies of your Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Your Information, including your Personal Information, may be retained for as long as needed to fulfill a legitimate business need or as required by law.
We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of your Personal Information. We warrant the security of any information you transmit to us or store on the Service and you do so at your own risk.
If we learn of a security systems breach, we may attempt to notify you electronically and will post a notice through the Service so that you can take appropriate protective steps.
Protecting the privacy of young children is especially important. For that reason, children under 18 are not permitted to use the Service and we do not knowingly collect or maintain Personal Information from persons under 18 years-of-age, and no part of the Service is directed to persons under 18. If you are under 18 years-of-age then strictly do not use or access Service at any time or in any manner.
Although we may allow you to adjust your privacy settings to limit access to your information, please be aware that no security measures are perfect or impenetrable. Information you post on the Service such as reviews are accessible to be viewed by other users. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. You understand and acknowledge that, even after removal, copies of information that you have posted may remain viewable in cached and archived pages or if other users have copied or stored such information.
Asilimia is in no event responsible or liable for any form of damages (be it direct or indirect) arising from the use of the Services. No expenses shall be charged to Asilimia or its employees for any potential breach of this Agreement by a user.
